Healthcare Labor Activity on the Rise: What Employers Need to Know

Campaign to Organize Doctors Nationwide

McDermott Employment and Healthcare Practice Groups invite you to explore the legal implications, challenges, and opportunities surrounding this critical matter on July 10 at 11 a.m. CT.

Union efforts targeting physicians and their employers, either individually or jointly, are expected to increase significantly. The American Federation of Teachers has recently initiated a campaign to “organize doctors nationwide,” following successful National Labor Relations Board (NLRB) elections by the Doctors Council SEIU. Recent NLRB updates have introduced expedited processes for union elections and recognition, which unions will utilize. Despite these challenges, they can be managed with prompt response plans, proactive and constructive next-generation engagement, and robust adherence to the National Labor Relations Act (NLRA).

Discussion topics will cover:
  • Recent campaigns organizing physicians and updates in NLRA regulations
  • Factors motivating unionization in healthcare, including impacts from mergers, acquisitions, and COVID-19
  • Strategies for proactive, efficient, and genuine direct engagement
  • NLRA compliance strategies

Begins September 1

Aetna will adjust its payment policy for surgical services provided in Urgent Care centers, as well as standalone centers.

They will start reimbursing these procedures at 75% of the agreed-upon rate. This update is a move to broaden the scope of their modifier 54 policy to encompass services rendered at locations with codes 20 and 49, which represent Urgent Care and independent clinics, respectively. Additionally, Aetna plans to apply similar reductions to payments for surgeries billed by nurse practitioners or physician assistants. Infectious disease complaints represent 15-20% of visits to practitioners or well over 100 million visits per year in the U.S. A large number of these visits are associated with a subsequent prescription with rates of overprescribing of antibiotics at approximately 50% for respiratory conditions and >25% for other syndromes. Patterns of infectious syndromes have seasonal features with cases of sexually transmitted disease, urinary tract and wound infections more prominent during summer months. In this webinar, we will present common case scenarios, share targeted insights on the epidemiology of these syndromes, and illustrate how multiplex PCR (Polymerase Chain Reaction) with next-morning results can enhance diagnostic precision, treatment accuracy, and patient satisfaction.

  • An approach to the efficient evaluation of select summertime infectious disease complaints (patient interview, exam, and medical decision-making) in the busy urgent care setting.
  • Understand the rationale of PCR with next-morning results as a diagnostic insight to improve medical decision-making and treatment planning.
  • Review the epidemiology of select infectious disease syndromes that have a peak during the summertime.
  • Discuss future directions in evidence evaluation on the use of multiplex PCR in the outpatient setting.
